This one passed me by, but after reading eBay's response, I just had to post up about it, even though it happened over a month ago!
Louis Vuitton (LVMH) was successful in their case against eBay where they accused them of selling fake goods. Typically, eBay's defense was that they didn't handle the products.
eBay also vowed to lodge an appeal and gave a completely ridiculous statement afterwards that really does some up their attitudes towards the fake products that they promote on their site.
From the Yahoo! news page:
"This decision is not based on combating counterfeit material. It is based on LVMH's desire to protect its commercial practices and exclude competition," said a spokeswoman for eBay in Paris.
"This is being done at the expense of the consumers and sellers to whom eBay is always offering opportunities," she added.
Excuse me? Being fined for selling fake products is going to be to the detriment of your consumers? LV are trying to stop competition? What competition?! If eBay considers counterfeiting to be competition, then they shouldn't really be stopping people from selling pirated software and media, because they're also just competition for the media industry.

eBay won a legal battle against the famous Tiffany brand which had decided to take action against the online seller due to counterfeit items found on the auction website.
The outcome was that eBay is NOT responsible for what is sold on it's site and it is up to the trademark owner to bring an item to the attention to the police.
I agree with eBay that it was sad that Tiffany didn't work with them to improve their processes rather than take them to court, but surely eBay have an interest in allowing such items to be sold because regardless of the item's origin or legal status, they get paid.
With everything being faked and easily available on eBay to an international audience, eBay cannot take this is a victory in my eyes, they really need to make it easier to report fake items and actively invite trademark owners to join their various programs that allow them to remove suspect items from eBay.
